These Everlaw Webinar Raffle Rules (the “Rules”) govern the operation of the Everlaw Webinar Raffle Drawing (the “Promotion”). In these Rules, “we,” “our,” “us,” and “Everlaw” refer to Everlaw, Inc., the sponsor of this Promotion located at 2101 Webster St Suite 1500, Oakland, California, 94612 USA, and its affiliates. “You” refers to an eligible Promotion participant.
PROMOTION DESCRIPTION. Everlaw is offering a $50 gift card to 10 randomly selected individuals who attend our webinar entitled “Mastering Email Discovery: An Everlaw Search Treasure Hunt” on April 30, 2024 (the “Event”). The only requirement for this raffle is to attend the webinar.
START AND END DATES. The Promotion starts at 10:00 a.m. PT on April 30, 2024(5:00 p.m. GMT on April 30, 2024), and ends at 11:00 a.m. PT on April 30, 2024 (6:00 p.m. GMT on April 30, 2024) (“Entry Period”).
ELIGIBILITY.
Requirements. You are eligible to enter this Promotion if you meet the following requirements: (A) You are 18 years of age or older; (B) You are a legal resident of 1 of the 50 United States and District of Columbia (excluding Puerto Rico, all United States Territories and all overseas military installations), the United Kingdom or Canada (excluding Quebec; (C) You are not an employee of any Everlaw corporate entity; (D) You are not an immediate family (e.g. parent, sibling, spouse, child) or household member of an Everlaw employee, or a person involved in any part of the administration and execution of this Promotion; (E) You are not a resident of any of the United States embargoed countries; (F) You are not an individual or entity restricted by United States export controls and sanctions or any other nation’s or state’s applicable law; and (G) You are not resident of any state, province, or country whose laws prohibit this Promotion.
Government Employees Excluded. Everlaw is committed to complying with government gift and ethics rules and therefore government employees are not eligible.
ENTERING THE PROMOTION.
Method. To enter online during the Entry Period, you must register for and attend the Event on April 30, 2024, from 10am- 11am PST You must attend the entire Event to qualify.
Ineligibility. Content in violation of the Everlaw Community Code of Conduct, including spam, is not eligible for entry.
Entry. If you meet the requirements in Sections 4.1 and 4.2, we will enter 1 entry into the drawing on your behalf (an “Entry”).
Alternative Means of Entry. To enter by mail without obligation, hand write your name, mailing address, phone number, and email address on a 3” x 5” card and mail to: Everlaw Webinar Raffle Drawing, 2101 Webster St Suite 1500, Oakland, California, 94612 USA. Mail-in entries must be postmarked by the entry deadline and be received within 5 days of the Entry Period. You will receive one Entry per mail-in card received.
Maximum Number of Entries. Up to 1 Entry per person is permitted, regardless of method of entry. Entrants violating any of these Rules may be disqualified.
PRIZE. There will be 10 winners. The prize for each winner will be one $50 (or the local currency equivalent) gift card (chosen by the winner from a selection of gift card options provided to you by Everlaw via Postal . Additional terms may apply to use of the gift card. Each Prize has a retail value of $50 USD (or the local currency equivalent). Prizes will be awarded only if the prize winner fully complies with these Rules. All Prizes are non-assignable and non-transferable. All details and other restrictions of the Prize not specified in these Rules will be determined by Everlaw in its sole discretion. No cash alternative or substitution of the Prize will be allowed, except Everlaw reserves the right in its sole discretion to substitute a prize of comparable value if any Prize listed is unavailable for any reason. All federal, state, provincial and local taxes are the sole responsibility of the winners.
WINNER SELECTION.
Process. Winners will be selected within 10 days of expiry of the Entry Period. The winners will be selected by Everlaw in the presence of an independent observer in a random drawing from all eligible entries received by the end date of the Promotion (the "Draw"). Any selected entrant who is a resident of Canada may be required to successfully answer a mathematical skill-testing question before being declared a winner. Odds of winning depend on the number of eligible entries received for the drawing. ANY VIOLATION OF THESE RULES BY WINNER WILL RESULT IN WINNER’S DISQUALIFICATION. We will notify the winners within 30 days of the Draw via the contact details provided through the survey submission. The winners need to accept their Prize by returning a confirmation message to training@everlaw.com within 10 days of notification. We, or our designated service provider, will send the Prize within 30 days of confirmation of the winner's acceptance of the Prize.
Alternative winner. We reserve the right to select an alternative winner in the event that a winner cannot be contacted after 2 attempts within 10 days of notification of being a winner, or the winner does not comply with these Rules or we have reasonable grounds for believing that a winner has contravened any of these Rules. If an alternate winner is required, we will randomly draw an alternate winner from the remaining valid and eligible entries.
OTHER TERMS AND CONDITIONS. By entering this Promotion You agree:
To accept and abide by these Rules;
To release, indemnify, defend, and hold harmless Everlaw and its affiliates, directors, officers, employees, agents and assigns, and any other organizations related to the Promotion from any and all claims, liability or any injury, loss or damage of any kind arising from or in connection with this Promotion (to the extent such liability can be released or limited under applicable laws) or any Prize won and claims based on publicity rights, defamation or invasion of privacy;
That our decisions will be final and binding on all matters related to this Promotion;
That, by accepting a Prize, we may make use of your proper name, state / country of residence, voice, and/or likeness online and in print, or in any other media, in connection with this Promotion, without payment or compensation to you, except where prohibited by law;
Not to use any automated entry device or software;
That false or deceptive entries or acts will render you ineligible;
That we, our affiliates, agents and employees will not be liable for any of the following where caused by factors beyond our reasonable control: (A) lost Entries; (B) electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind; (C) failed, incomplete, garbled, or delayed computer transmissions; or (D) any printing or typographical error in any material associated with the Promotion.
LIMITATIONS ON LIABILITY. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the below limitation or exclusion may not apply to you. IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, CIVIL LIABILITY OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
USE OF DATA. We will be collecting personal data about entrants, in accordance with our Privacy Notice available at https://www.everlaw.com/privacy-notice/. By participating in the Promotion, you agree and acknowledge that you have read Everlaw’s Privacy Notice and agree to Everlaw’s collection and usage of your personal information in accordance with Everlaw’s Privacy Notice.
GOVERNING LAW AND DISPUTE RESOLUTION. To the fullest extent permitted by applicable law, these Rules are governed by the laws of the State of California, without regard to its conflict of laws principles. To the fullest extent permitted by applicable law, any dispute will be resolved by binding arbitration, rather than in court, except that you may, to the maximum extent permitted by law, assert claims in small claims court. To initiate an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to legal@everlaw.com. The parties agree that the dispute will be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules and that judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. The arbitration will be held in Oakland, California, or any other location both parties agree to in writing. If we prevail in arbitration, we’ll pay all of our attorneys’ fees and costs and won’t seek to recover them from you. If you prevail in arbitration, you will be entitled to an award of attorneys’ fees and expenses to the extent provided under applicable law. Except as may be required by law or as necessary to enforce the respective award in a court of law, neither party, nor the mediator or arbitrator, may disclose the existence, content, or results of any mediation or arbitration without the prior written consent of both parties.
TERMINATION OF THE PROMOTION. We reserve the right, in our sole discretion, to cancel, terminate, modify, extend or suspend this Promotion for any reason, in particular if a secure, fair and proper conduct of the Promotion is affected.

PROMOTION IS VOID WHERE PROHIBITED. Notwithstanding anything else contained in these Rules, this Promotion is void wherever prohibited by law.
