“A few years ago, we were part of a big telecommunications case in which Gibtelecom, which is our client, and Rockolo Limited, another one of our clients, were defending a multimillion-pound competition claim brought by one of its biggest competitors,” Marrache said. “When we saw the number of documents that had to be reviewed as part of the disclosure process, we needed to look outside the box to what we had historically done when it came to disclosure. We decided to reach out to a few companies, one of which was Everlaw, and we particularly enjoyed Everlaw's features. It was very modern, clean, and user-friendly.”
In that particular case, Marrache and the Hassans team uploaded hundreds of thousands of documents in Everlaw.
“We initially started with a review pool of some 700,000 documents, and were able to use Everlaw to whittle that down to about 30,000 documents that we actively reviewed,” Marrache said. “And now we have a similar task in a separate Gibtelecom case, where we started with even more documents having to be reviewed.”
Without Everlaw, going through those 700,000 documents would’ve been a time-consuming and administratively impossible process for Marrache and his team.
Empowering Administrators to Take Charge of Cases
One of the things Marrache enjoys most about the Everlaw platform in addition to its review capabilities is the ability to administer and manage Hassans' major Everlaw projects.
“From an administrator standpoint, I really appreciate the ease of being able to manage who has access to what,” Marrache said. “I can give different practitioners access to different documents and workstreams, and set tasks for each user on the platform. It’s really easy to add people to the platform and decide exactly what permissions they require.”
This also helps him see who is struggling with the review process, so he can identify issues early and offer assistance to whoever needs it. When managing teams of contract review attorneys, this can be especially useful.
“I can go back to the trainees that are doing the disclosure tasks, and I can see a range of useful statistics, including how many documents are being reviewed per hour,” Marrache said. “This gives me the perfect opportunity to sit down with anyone struggling with the review process, identify what issues exist and remedy those so that the review process can continue smoothly. Oftentimes a reviewer might require some additional training, and this can easily be organized through Everlaw’s self-help resources or the very helpful support staff.”
Marrache also appreciates this functionality for reviewing documents, something he does a lot of as a Senior Associate.
“I do a significant amount of document review myself, and Everlaw makes that easy to do,” he said. “Everlaw is very user-friendly and easy on the eyes. Some of my favorite features include the preset highlights for keywords, which immediately direct you to the areas of a document you should be looking at. The manner in which Everlaw can compile email correspondence as a chain of emails and attachments also helps you see where certain documents and emails fit in a chain and find the ones you need to follow.”
Overcoming Hurdles During Trial Preparation
When it comes to preparing for trial, time is of the essence. Moving quickly and efficiently is crucial to getting ahead.
Since they handle so much litigation, a comprehensive trial preparation tool that enabled the team to collaborate, review data, and build a case narrative was a vital part of what Hassans needed.
One particularly impactful way Marrache used Everlaw for trial preparation was in the multimillion-pound Gibtelecom competition case.
“We used Everlaw to search through hundreds of thousands of documents for keywords during the trial preparation process,” he said. “This extended to using Everlaw during trial itself so that if a witness said something about company Y, we'd type ‘company Y’ into the search function, and we’d put whatever filters we needed and we’d produce all the documents for company Y that evening. We’d stay late, reading up on everything related to company Y so we could then cross-examine the other side on the material we had come across in the discovery. It was very helpful and extremely effective.”
